Own Your Superstar Mentorship – Terms and Conditions

  1. COACHING PROGRAM
    The coaching program is a partnership and co-creation between TMM (The Mahima Mindset) and Student, where TMM helps Student get clear and develop personal and professional goals and blueprints. The program consists of Education, Business Strategy, Personal Development, for a period of 12 months. The agenda can be amended by TMM based on Students needs and circumstances. All 1:1 calls included in this program must be completed within 12 months from the original date of the kickstart webinar. There will be no credit for calls or meetings not completed within this time (no show).
  2. PAYMENT FOR ENROLMENT – PAID IN FULL OPTION
    Your participation in the mentorship program is only confirmed and starts after your mentorship tuition is paid in full. Student will be placed on a waiting list and not considered enrolled until the full payment for the program is completed.
  3. PAYMENT FOR ENROLMENT – PAYMENT PLAN OPTION
    Student and TMM will agree on an individual payment plan. Students needs to provide bank or credit card details for the payments.
    We reserve the right to cancel the enrolment within 7 days and a refund will not be available if student will not provide payment details within the 7 days. Payment plan options carry an interest penalty until 10%. We will not accept any enrolments until we receive a minimum of 30% deposit. Any changes in payment plan must be received/communicated in writing via email 7 days prior to the next scheduled debit date and must be agreed by Student and TMM.

  4. ENROLMENT CANCELATION – BY CLIENT
    Should Student choose to cancel or reschedule the enrolment, we will not be able to avoid the costs involved for your commitment. For this reason, we charge a fee for the cancellation or rescheduling of Students enrolment as indicated below.
    If Student chooses to cancel the enrolment for any reason within 5 business days of completing this form (the “cooling-off period”), then we will refund the total amount paid to us deducting processing fees, between 5% – 10%. Please allow up to 7 business days after your refund has been approved for your refund to be processed. If, however, the Student chooses to cancel the enrolment for a specific reason after the cooling-off period, Student will receive a credit only. Credits may not be claimed as refunds; but may be applied towards an enrolment in any of other programs or products offered within a period of 12 months. All requests to cancel or reschedule the enrolment must be received by us in writing via email. Products and bonus items are non-returnable
  5. ENROLMENT CANCELLATION – BY THE MAHIMA MINDSETT
    If at any time during the course of the program – after the cooling period is over – TMM evaluates that the clients behavior is inappropriate and not in alignment with TMM values and rules of engagement outlined clearly in the recorded jumpstart webinar – TMM reserve the right to cancel the Student’s participation without refunding any payments already made. TMM will always initiate, sincere discussion opportunities to support student to improve any inappropriate behavior or conduct, before such measures would be implemented.
  6. MEETING SCHEDULING
    All sessions are to be scheduled in advance by direct correspondence between Student and TMM. Student shall attend timely the scheduled sessions and understands that a “no show” to any of the sessions forfeits that session completely from the program. There are no make up sessions or refunds. Session will take place via zoom (or other online tools) and the session agenda will be set each time by TMM / Coach and communicated to the Student before each session. Telephone calls upon Student’s request during the program are at the Student’s expense. Student agrees to be ready and available ten minutes prior to each meeting, and communicate as early as possible, if there will be a delay. If for any reason Student cannot attend a previously scheduled session, Student shall inform the Coach at least 48 hours in advance to arrange alternate times
  7. EVENT RESCHEDULING/ CANCELLATION
    Any rescheduling of the live events is subject to seat availability in the next seminar with the same speaker. Students agrees that TMM may not convene the same seminar again and there is no obligation on TMM to do so. Any event purchased and rescheduled by the Student, can be replaced by attending another event within 12 months of the initial purchase. If not, the purchase price and fees will be forfeited. If Student does not show up at a live or online event or seminar without prior notice and rescheduling, the full cost of that purchase will be forfeited as well.
    If, for any reason TMM deems necessary to change a seminar or event date, venue, speaker, content, title or hours, it will inform Students duly and Student will be entitled to reschedule its enrolment without any penalty. In the event of unusual unexpected incidents that are out of TMM’s control, i.e. natural catastrophes, strike, political unrest, epidemic and pandemic, TMM can cancel or postpone any events or sessions for the duration of such crisis and will inform Student in a timely manner. Student’s spot for the cancelled or postponed event or session will be secured to catch up with the occurring events or session after the crisis.
  8. CONFIDENTIALITY
    TMM shall keep all information and data supplied to it by Student in confidential, and not disclose confidential information without Students prior consent, to any person, other than to a person who is directly involved with the Student’s program, and whose knowledge of such information or data is essential for such purposes. This section does not apply to information, which are already known or available to the public, or if TMM is obliged to disclose such information in front of a court of law or other legitimate authorities. Student agrees however that they may be captured in photos or videos during the live events or online events and that TMM can use theses materials for marketing purposes.Student shall keep all information and data supplied to it by TMM in confidential and not disclose confidential information without TMM’s prior consent, to any person. This section does not apply to information, which are already known or available to the public.
  9. INTELLECTUAL PROPERTY
    Student agrees that all program materials provided by TMM are confidential and shall not be used, disclosed, reproduced or duplicated. Some of the TMM’s materials may be unpublished works protected by International copyright laws and so no unauthorised copying, adaptation, distribution or display is permitted. At no time during or after the termination of this agreement shall Student make any claim to the acquisition of the ownership of any of the intellectual property rights or use any of the intellectual property of the materials, other than as allowed pursuant to this agreement or to TMM’s prior consent. The unauthorized use of any of the materials described above could cause irreparable harm and damages and will be subject to legal measures against Student. Student agrees to not at any time do anything that may infringe the intellectual property rights.
  10. LIMITED LIABILITY AND INDEMNIFICATION
    Student acknowledges that the coaching services are educational only (no mental, emotional or physical treatment) and that Student bears the sole responsibility for the use and implementation of this information in its own business as well as its physical and mental conditions as well as financial consequences. TMM therefore makes no representations and gives no warranty to the accuracy or completeness of the information and material delivered. TMM can at any time assign certain tasks or responsibilities to a third person or expert at its discretion. Student agrees to forever indemnify and hold harmless the TMM and its shareholders, directors, officers, employees and contractors from and against any actual or consequential loss, cost, expense or damage whatsoever resulting from Student’s activities and related to the subject matter of the program herein.
  11. STUDENT SATISFACTION
    If any product that you received during the program or the events is found to be faulty, we will replace it within 10 business days starting from your written request and return of the faulty product. Student is solely and primarily accountable for its own actions or inaction and the results produced by following and implementing TMM’s instructions. TMM is not responsible for generating results and makes no guarantees, representations or warranties with respect to the results of the coaching services negotiated, agreed upon ad rendered. Student agrees to communicate immediately and openly to TMM in writing, if there is something that TMM can do to help facilitate a more suitable, professional or results-driven environment or education for Student.
  12. GENERAL PROVISIONS
    This Agreement contains the entire understanding between the parties, supersedes any prior or contemporaneous written or oral agreements, understandings and representations between them respecting the subject matter contained in this Agreement, and replaces all prior negotiations concerning such subject matter into this agreement. Should any part of this agreement be determined by a court to be invalid or unenforceable, the remainder of the agreement will be unaffected. This agreement may not be amended except with the written approval of the parties. This agreement terminates with the completion of the coaching program. Any termination initiated by either party – before the program completion date – shall be discussed and communicated with written mutual consent of the parties pursuant to section 6 of this agreement.
  13. DISPUTE RESOLUTION – APPLICABLE LAW
    For any dispute, controversy arising out of, in connection with, or in relation to this Agreement and any amendments to this Agreement or a breach of this Agreement, the Parties agree to attempt resolving the dispute – under exclusion of public court proceedings – first by negotiating in good faith. If the dispute cannot be resolved between the parties, they shall deliver a notice of submission of a dispute to an independent arbitrator appointed pursuant to the Swiss Arbitration Rules, in force on the date when the request for arbitration was submitted in accordance with these Rules. The substantive laws of Switzerland govern this agreement. The jurisdiction is Zug, Switzerland. The language of the dispute resolution sessions and correspondences will be English.
